Who Are The Main Investigating Authorities?
Most criminal investigations are carried out by the Police, HMRC, The SFO, The FCA. Local Authorities, The DWP
How are Investigations Conducted?
In the most serious allegations there will be no notice of the investigation given and an arrest will be carried out. This will mean interviews with little or no proper opportunity to prepare for questioning, not having access to material that you may require to be in a position to put across reasonably your defence.
You may then be placed on bail for a period of time, with or without conditions. Your assets may be frozen in some instances.
You may be given advance notice of an interview and are able through negotiation to obtain the documents that are to put to you.
The approach taken by the investigating authority depends on a number of factors, such as the type of matter being investigated, how advanced the investigation is before you are called in and the reasonableness of any requests for pre-interview disclosure that can be made on your behalf.
Yours Rights During the Course of Interview?
Interviews alleging criminal conduct may be conducted at a police station, or at the Offices of the Investigating Authority and even in some circumstances the Offices of your Lawyers.
Interviews are conducted subject to safeguards which arise from the Police and Criminal Evidence Act 1984. This means that you do not need to be arrested simply due to the fact that an allegation of criminal activity has been alleged against you. The interview will be recorded and will only commence once you have been Cautioned and given the opportunity to have a Legal Representative present during the course of the interview, who will advise you as to how best you should proceed. You may be advised to not attend an interview if the circumstances do not merit an explanation.

Spending time properly preparing your case for presentation significantly reduces the prospects of your facing proceedings.
Obtaining material and evidence from the Investigator in advance of interview where possible, especially in the current climate where more interviews take place by Voluntary Arrangement will place you at an advantage.
